Why UK(Britain) is a haven for fugitives?

From Tiger Hanif to Nirav Modi Indian government has failed to bring back anyone who left Indian soil and took resort in United Kingdom. Despite all its powers that India develops, these bad guys are successful to leave the country and why every Indian fugitive seeks refuge in UK (Britain) only? Does India not possess powers to extradite any defaulter or bad guy? Do they get support from the British law or money speaks louder? What is the reason for that? Lets check it out!

Around the globe India is only a major victim of this malpractice. A report form news portal-"Economic Times" says that over 5,500 people from India have sought a resort in Britain since 2013. India has been trying very long for the extradition for fraudsters and defaulters like Vijay Mallya but there is no growth in this process. However India is not only the victim, there are also other defaulters of different nationality like Pakistan, Albania, Colombia etc. Although India and other countries are trying to extradite the their defaulters but the process is too slow to apprehend.

Almost every criminal seeks hideout in Britain only. There are several reasons attached to it. Tiger Hanif, Lalit Modi, Vijayy Mallya, Ravi Shankaran and others have been spotted in UK in their times. Both the countries India and UK have signed a treaty of Extradition in 1992 but observing the current behavior of UK it can be just regarded as hoax. A major reason is constitution of UK which is very similar to India's constitution. The likeness of constitution and similar environment helps these fraudsters to find a loop hole in the law. Usually they hire a lawyer who has studied both Indian and British constitution seamlessly then these advocates advises do's and don't's. With these connections they live easily in UK.

  • Vijay Mallya- A Kingfisher Airline defaulter who is firmly accused for a default of 9,000 crore Rs. loans, money laundering, and fraud. He is currently enjoying in UK and on the other side India is trying hard to extradite him as soon as possible.
  • Nirav Modi and Mehul Choksi- These men are accused in the fraud of Punjab National Bank on default of 12,636 crore Rs. by using fake letter of undertaking. Mehul has got connections with PM Modi and is currently an Antiguan citizen while Nirav Modi have been spotted in London.
  • Sanjay Bhandari- Another fugitive accused with tax evasion, stealing of defence ministry documents. He has a mansion in London where he lives very easily.
  • Tiger Hanif- An associate of underworld don Dawood Ibrahim accused for Gujrat blast case in 1993. He is also enjoying the English hospitality.
  • Lord Sudhir Choudrie- A UK based billionaire and arms dealer accused and investigated for bribery in defence deals. He was awarded Asian Business Lifetime Achievement Year Award 2013, by none other than the current British PM Theresa May, when she was Home Secretary.
  • Nadeem Saifi- He is a murdrer of music baron Gulshan kumar. India cannot do anything to him because he is a British citizen and currently living in UAE.
There are some more like Sanjeev Chawla, Ravi Shankaran etc. who are living their accused life happily in UK.

Strong Human Right Laws 
The British Human Rights Commission is considered to be more strict and human factor than the Human Rights Commission of the world and countries. If UK court deem that a person when extradited, is likely to face torture or death penalty, or the extradition is due to political reasons(just like Mallya and Nirav) then they might deny the extradition request.

Delay in the process
Just like bureaucratic works in India the extradition process are very slow in UK. Including Vijay Mallya, India has made nine Extradition requests. The Extradition treaty was signed in 1992 from then only one request have only been passed and that of Samirbhai Patel accused for Gujrat Riots(2002) in 2016. Since then not a single request had been passed by the UK government.

Money Muscle
It true that sometimes money speaks louder. Another reason for failure in extradition is wealth. The British constitution allows the people who contribute regularly in nations wealth. This means that whoever might come to England for refuge they must be contributing to England irrespective of the source of income. This can be corelated with Swiss Bank process.

There are also some rejected extraditions of several fugitives like Maninder Pal Singh, Somaia Ketan and many more. The solution of this problem lies in our constitution and government. If the Indian constitution is strict for this acts and the Indian government is firm on their demand of extradition then this problem can resolve.
